1. Requirements for Using Our Site and Agreeing to the Privacy Policy
In order to maintain our marketplace's functionality, there are certain pieces of your information that we need to collect and process.
To participate in our Services, you must agree to our Terms of Use. As part of this agreement, you confirm that you have read and understood our Privacy Policy. This policy details why we use your personal information, and how we do so. If you do not agree to the use of your information as described in this policy, you may not use Newlabel.
Please note that Newlabel cannot and does not claim responsibility for the content or the privacy practices of individual Newlabel _ members or third parties, including other websites and mobile apps.
To use our Services, you must be at least 18 years of age. The only way minors between the ages 13-17 may use Newlabel is with the account of and permission from a parent or legal guardian. Minors must have the appropriate consent and direct supervision of their parent or legal guardian while using Newlabel. Note that if a minor uses your account, you are responsible for all activities that the minor conducts. Children younger than 13 may not use Newlabel, including any of our sites or apps.
As a Newlabel member, your information will be viewed by appropriate parties only in the United States and any other nation in which Newlabel conducts operations. Your use of the Services constitutes an acknowledgment of an agreement to this use. It is important to note that privacy standards and personal data laws may vary from one country to another. This includes the rights of authorities to obtain your data. Newlabel will transfer our users' personal information only to the countries where we are legally permitted to make such a transfer. Furthermore, Newlabel will make a conscientious effort to ensure that our users' data receive appropriate protection.
2. How Newlabel Collects, Receives and Uses Your Personal Information
Newlabel may ask for or obtain your personal information through a variety of means. In most cases, you will have the opportunity to determine what personal information you provide to us. However, some specific pieces of information are required for us to offer you our Services.
Registration, Account Setup, Service Usage: At a minimum, our Services' use requires a valid e-mail address. For those of our Services that require registration, we need a full name. The name that you provide will be associated with your account and will be how you are represented and identified in the Newlabel community. After you've provided a name, the name can be modified or removed via your Newlabel account preferences. For certain aspects of our Services, further personal information will be required, including a contact name, billing address, shipping address, shop name, telephone number, and credit card information. You will not need to provide this additional information as part of the sign-up process. However, you will need to provide it if you participate in a specific Newlabel service that requires it (e.g., you won't be able to purchase a physical item without providing a shipping address).
We also require additional information from Newlabel sellers who use the Newlabel _ payment service. These sellers may need to provide a full legal name, date of birth, credit card information, a tax ID (or other identification ID, or social security number, as applicable), bank account information, and additional personal information. The information provided will be used to verify identity, comply with relevant laws, and fulfill our requirements in offering the Services. Credit card information may be stored, either by a third party or by us for seller payouts and billing. Depending on your local laws, you may have the option to consent to have us store your credit card information for use in future purchases. At certain times, we may contact sellers confidentially to collect relevant information about the seller's shop, about the items the seller has listed for sale, or about compliance with regulations and applicable laws. Some of our Services (and products on our Services) require an application process. Unless explicitly stated otherwise, the information submitted through one of these applications only for internal use. We'll never display them on a public forum.
Profile: Your profile allows you to share your name, birthday, gender, geographic location, and other personal information associated with your account and activity. It is up to you whether you provide this information. At any time, you can delete or edit your public profile information via your account preferences.
Please note that your account's name is displayed in connection with all your public activity on Newlabel. This activity can include any of the following information:
The date that you joined Newlabel
The profile information you chose to publish on our platform
Items you posted for sale
Your shop's policies and other pages
Comments you've posted
Reviews and Star ratings for items bought and sold
Your followers
Who you follow
Any posts shared through third-party networks.
Automated Information: Each time you visit our Site, open the Apps, or utilize another of our Services, some information is automatically received and recorded from your browser or mobile device. This information includes your IP address or unique device identifier, cookies stored in your browser, and data about the pages you visit. We use this information, which is stored in log files, to keep Newlabel operational and to optimize our users' experience of the Services. This automatically recorded information may be used in combination with other information we have collected about you (or that our partners have collected about you on our behalf), on the same device or across multiple devices, for several important purposes. These purposes include analyzing and optimizing our Services, providing targeted advertising and personalized experiences, and keeping the Services secure by preventing fraud and recognizing unauthorized access to member accounts.
When you install, access, or otherwise utilize our Services, we may collect additional information specific to your device, including operating system information, hardware model, app usage, debugging reports, app version, and related data. If you'd like to know more about the information that we obtain from your device, we encourage you to read our Cookies & Similar Technologies Policy. Please also refer to the "Using and Sharing Your Information" section of this document.
Location Information: The primary reasons that we collect and record information about your interaction with our Services are to offer personalized content and targeted advertising, to understand better and analyze Newlabel's operations, and to protect Newlabel from fraud and disruption. The data that we collect may include the following: device information (like iOS IDFA and Android AAID, among other pieces of data), browser information (such as referring domains that led you to our Site), IP address, and, potentially, location information. Our Apps offer the option of sharing your geolocation details with us. Doing so enables you to take advantage of location-specific functionalities such as our local marketplace and integration with digital maps. You are not required to share your geolocation details to use the Apps. Additionally, as a seller, you have the option of publishing your location.
Information about your location may be obtained from your profile (if you've publicly shared your location) or your IP address. More precise location data may be obtained from the GPS on your mobile device, or cell towers or wireless networks in range of your mobile device. We will secure your consent before collecting precise location data. Once we have this location information, we may record and utilize it to offer our Services a more customized experience. Examples of this customization include the implementation of regional requirements and policies, the display of local content in search results, and the availability of accurate shipping estimates and mapping services. We may also use location information for internal performance monitoring and Site analytics and marketing purposes. Only non-precise location data will be used for marketing purposes.
If you choose to enable the sharing of precise geolocation details, we may share these details with third parties to provide you with the Services, such as payment processing, mapping services, and (to a limited extent) marketing. At any time, you can withdraw your consent to share your precise location data with us. You may change your preferences regarding specific location data via the settings on the Apps, or the settings on your mobile device. However, we require that you share some non-precise location data with us to keep the Site running smoothly. Uses for the required non-precise location data include security authentication and applying localized policies. Non-precise location data may come from your IP address or from the address you have on file. You also have the option of allowing the Apps to access the camera on your mobile device, which will enable you to upload photographs to Newlabel.
Analytics Information: Data analytics are a critical part of our ability to ensure that Newlabel is functioning correctly and making improvements to our Services. To understand how our users engage with our Apps, we utilize mobile analytics software that captures information about app usage. Information collected by this software may include the frequency with which you use the Apps, performance and speed data, debugging information, the platform from which you downloaded the Apps and activity within the Apps. The data collected by our analytics software is not tied to personally identifiable information submitted within the Apps.
Information from Third Parties: We may receive information submitted through an external third-party application when a Newlabel member or visitor chooses to connect with our Site or register a new Newlabel account through that third party. Examples of such external applications include Twitter, Facebook, and other social networks, and apps developed using the Newlabel API. Information that we obtain through the third party may be used to provide you with the Services. It is entirely optional to connect your Newlabel account to any external third parties (although we may obtain publicly available information on social networks to connect with you). You have the option of sharing certain aspects of your activity through linked social media accounts. You may revoke your consent to share your activity on any social media network via your Newlabel account preferences at any time.
Non-Member Information: For this section's purposes, we'll refer to anyone who doesn't yet have a registered account with Newlabel as a "non-member." We may collect or receive an e-mail address, IP address, or other information about a person while still a non-member. This can happen in several different situations:
You're a non-member invited to a page on the Site by a member.
You're a non-member subscribing to Newlabel's blog.
You're a non-member using the guest checkout option, or otherwise engaging in a Newlabel transaction
You're a member sending a gift code to a non-member.
When we collect or receive information about a non-member, we use that information only for the express purpose that we disclosed when the information was submitted to us, or to carry out an action that has been requested and authorized by the non-member.
Pattern by Newlabel: As previously explained, Newlabel collects personal information from members such as unique device identifiers, IP addresses, and information about the cookies stored in members' browsers. This information may also be collected from non-members. If you'd like to find more information about websites hosted via Patterns by Newlabel, we encourage you to read our Pattern Policy. 3. User Preferences and Options
As part of our commitment to transparency in our privacy practices, we think it's extremely important that you control your own personal information. (It's yours, after all!) That's why we make it easy for you to add, delete, or modify your profile information in your Newlabel account. You can always alter the information associated with your Newlabel _ account via your account preferences. We also provide you with several options in your account preferences to choose how you want us to get in touch with you.
Optional information, such as your name, can be removed so that it is no longer publicly available. If you'd like, you can request the personal data associated with your account to be deleted entirely.
Depending on your location, you may also have certain additional rights concerning your information, such as:
(i) data access and portability (including the right to obtain a copy of the personal data you provided to Newlabel , via your settings);
(ii) data correction (including the ability to update your data, in many cases via settings);
(iii) data deletion (including the right to have Newlabel delete your personal information, except information we are required to retain, by contacting us); and
(iv) withdrawal of consent or objection to processing (including, in limited circumstances, the right to ask Newlabel to stop processing your data, with some exceptions, by contacting us).
It's important to note that Newlabel _ uses cookies and a variety of related technologies that are non-technically necessary. We provide in-depth information about these technologies--and the choices you have for opting out of them--in our Cookies & Similar Technologies Policy.
Via your account preferences, you also can change whether you receive some types of communication from us. Although some types of communication (such as service-related messages regarding transactions or legal notices) are required, other classes, like newsletters, are not required. You may opt-out of any free communication from Newlabel within your account preferences. To find out more about how we communicate with you, please see the "Communication with Newlabel" section of this document.
It's important to note that Newlabel partners with certain third parties who help us manage our marketing and advertising on external sites. These third parties may use cookies or closely related technologies of their own. We may use such technologies to show you ads and recommendations based on your online activity and browsing behavior. Within your account preferences, you can alter the settings and change the permissions granted to third-party applications that may be connected to your seller/buyer account, like apps developed using the Newlabel API or social networks like Facebook.
If you've decided that you do not wish to receive any communication from us, or if you no longer want to be part of the Newlabel community, you are free at any time to terminate your account. We provide more information about this process here. Please note that even if you close your account, we will continue to deliver legal notices to you as required by law.
Please be aware that, while many changes to your account-preferences will take effect immediately, others may take several days to update in our systems. This is especially true of changes to your preferences regarding e-mail or marketing communications. We may require you to verify your identity before we process changes to your billing information, request to close your account, or other account changes that we deem to be significant.
4. Connecting through Third-Party Services
As a Newlabel user, you can connect your account directly to your mobile device's address book, a social media account, or your e-mail service provider to import your contacts. If you choose to do this, you will not store the login information you provided for the connected accounts. By connecting to your mobile phone's contact list or by searching directly on Newlabel, you can search for individuals by phone number or e-mail address. We provide this functionality to make it easy for you to connect with people you know on our Site. Once you find someone you know on, you can choose to follow that person's public activity. If you do so, that person will get an e-mail (if they have elected to receive such notifications) informing them that you've followed them.
You have the option of changing your findability via your account preferences. If you turn off your findability, Newlabel users will not be able to find you on our platform by searching your phone number, e-mail address, or social network connections. You also have the option of removing your name and using an alias or nickname on your Newlabel profile, so that you aren't visible if someone searches for your name on our platform.
5. Communication with Newlabel
To provide you with messages regarding Newlabel transactions, marketing promotions, service updates, and other important information, we will sometimes need to get in touch with you. We'll typically communicate these messages via push notification or e-mail. By changing the settings on your desktop or mobile device, you can disable push notifications from Newlabel. If you wish, you may choose not to receive marketing communications from us by clicking on the "Unsubscribe" link included in all marketing e-mails. You may also opt-out by changing the e-mail communication settings in your account preferences. Because we must be able to reach you, we require all Newlabel accounts to have a valid e-mail address on file. We also collect some device information (such as operating system information) to make sure that you're receiving notifications from us. We may request that you provide a telephone number if you ask us to call you for transaction-related or other member support. We may also contact you via SMS, or an equivalent of SMS, for marketing or customer support purposes. We will only contact you in this manner with your consent. If you'd like to change your communications settings, you can do so through your account preferences.
Please be aware that some service-related messages are necessary, and we require that you agree to receive these messages. This applies both to members and to non-members who use Guest Checkout. Using our Services, you are granting consent for Newlabel to send e-mails and messages of a non-marketing purpose. Such messages or e-mails may be regarding your account, Newlabel transactions, or account security. For example, we will send a confirmation of your e-mail address when you register for a new account. We will also send notifications about orders from your shop, changes to service availability, new messages from buyers or our customer support team, and modification to site functionality and features.
By registering for a Newlabel account, providing an e-mail address or phone number for a Guest Checkout transaction, or subscribing to one of our newsletters, you are receiving the appropriate notice and consenting to, our practice of sending marketing messages and e-mails. (In relevant jurisdictions and circumstances, you will be required to provide additional unambiguous consent to such messages.) You may unsubscribe from marketing communications via the "Unsubscribe" link in our marketing messages and e-mails. If you're a Newlabel member, you can also opt-out of marketing e-mails and messages via your account preferences. We remind you that it may take several days for your new communications settings to go into effect.
We offer the option to connect with people you know through our contact importer feature. More information about this feature is available in the "Connecting through Third-Party Services" section of this document. For contacts who are not already Newlabel members, you can send invitations for them to join Newlabel . We will send these invitations on your behalf. The e-mail invitations will contain instructions to provide recipients with the option to opt-out of receiving invitations. Please note that you may only send invitations to individuals who have consented to receive one.
6. Newlabel as a Social Platform
To promote a sense of community among our members, we provide several features for buyers and sellers to engage with one another in public ways. These features include our Forums and Teams. It is entirely up to you whether you choose to participate in these community spaces. If you do join, we urge you to exercise caution and practice good judgment at all times. Information that you submit in these public spaces can be viewed and recorded by anyone and may be used to contact you with unsolicited messages. Any personal information that you post on Newlabel is entirely your responsibility. As a general rule, we do not delete content from public forums. Please be aware that, although you can remove your name, your posts in the Newlabel community spaces may remain visible and publicly available even after your account is canceled. Additionally, please note that we may partner with third parties to provide our community features. In doing so, we may need to disclose some of your information to those third-party partners.
You may choose to follow the public activity of other Newlabel members, and other members may decide to follow your public activity as well. Members who follow you will receive updates on your activity, like when you add a new item or a shop to your open favorites. You can, for any reason, choose to block any member from seeing your activity updates. You may also choose to make certain types of activity private to all members via your account preferences.
7. Using and Sharing Your Information
This policy describes how we obtain, process, utilize and share your personal information when you use our Services. To collect and use your data in the ways described, Newlabel relies on specific legal bases. Such legal bases include where:
a. Necessary to perform the contractual obligations in our Terms of Use and to provide the Services to you;
b. You have consented to the processing, which you can revoke at any time;
c. It’s necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims;
d. It is necessary for our or a third party's legitimate interests, such as those of visitors, members, or partners;
e. You have expressly made the information public;
e1. Necessary in the public interest; and
e2. Occasionally necessary to protect your vital interests or those of others.
Note that we principally rely on consent
(i) to send marketing messages;
(ii) for third-party data sharing related to advertising, and, to the extent applicable;
(iii) for the use of location data for advertising purposes.
Newlabel advertises the platform and sellers' products with third-party advertising partners like Google, Facebook, and others. We rely on your consent to do this. Our advertising practices include targeted online and offline marketing, using tools such as Google Customer Match and Facebook Custom Audience.
When we process your information based on legitimate interests, we do so as follows:
Providing and Improving our Services:
We may use your information to improve and customize our Services, including: Sharing your data for such purposes. This is necessary to enable us to pursue our legitimate interests in improving for our users.
This is also necessary to allow us to pursue our legitimate interests in understanding how our Services are used and to explore and unlock ways to develop and grow our business.
It is also necessary to allow us to pursue our legitimate interests in improving our Services, efficiency, interest in Services for users, and obtaining insights into usage patterns of our Services.
Keeping our Services safe and Secure:
We may also share your information for safety and security purposes. We do so because it is necessary to pursue our legitimate interests in ensuring our Services' Security, like enhancing the protection of our community against spam, harassment, intellectual property infringement, crime, and security risks of all kinds.
We respect your privacy.Newlabel will not disclose your name, e-mail address, or other personal information to third parties without your consent, except as specified in this policy.
We must utilize our members' personal information so that we can offer and optimize our Services and our platform. We use personal information for billing, payments, authentication, Security, identity verification, aggregate reporting, and analytics. Through our case system, we may utilize information to help our members settle and resolve disputes, either with other members or with us. Based on your online activity and purchasing behavior both on and off our platform, we may understand the products you have an interest in, and we may use that understanding to suggest certain products that reflect your browsing activity. As the provider of the Services, it is in our legitimate interest to customize the on-site experience of our members. This includes providing buyers with recommended items for purchase and helping sellers discover the most effective means of selling their items.
Because we value your right to privacy, you are in control of your Newlabel account's privacy settings. You may adjust these settings through the "Privacy" tab in your account preferences. Please be aware that it may take several days for specific changes to your privacy settings to go into effect.
In addition to consent, as noted above, we also rely on our legitimate interest to send you marketing messages and for Newlabel advertising programs.
Buying and Selling: As part of the buying and selling process, Newlabel will facilitate the sharing of information between the two members involved in the transaction, such as the other Newlabel member's shipping address and payment status. By making a sale or a purchase on Newlabel, you direct us to share your information this way. Since this is an integral part of the Services we provide, we need to do this to perform our obligations under our Terms of Use. We expect you to respect the privacy of the member whose information you have received. As described in Newlabel Terms of Use, you have a limited license to use that information only for Newlabel -related communications or for Newlabel -facilitated transactions. Newlabel has not granted a license to you to use the information for unauthorized transactions or send unsolicited commercial messages in violation of any applicable laws, including any consent requirements of the recipient's jurisdiction. You may only add a member to your e-mail or physical mailing list or otherwise use or store a member's personal information under applicable laws, including any consent requirements applicable in that member's jurisdiction.
Legal and Safety: Newlabel may also retain, preserve, or release your personal information to a third party in the following limited circumstances: in response to lawful requests by public authorities, including to meet legitimate national security or law enforcement requirements; to protect, establish, or exercise our legal rights or defend against legal claims, including to collect a debt; to comply with a subpoena, court order, legal process, or other legal requirements; or when we believe in good faith that such disclosure is reasonably necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our property, or violations Newlabel Terms of Use. In these cases, our use of your information may be necessary for our or a third party's legitimate interest in keeping our Services secure, preventing harm or crime, enforcing or defending legal rights, or preventing damage. Such use may also be necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims. It may also be required in the public interest (such as to prevent crime) or to protect vital interests (in rare cases where we may need to share information to avoid the loss of life or personal injury).
If Newlabel receives a lawful, verified request for a member's records or information in one of the limited circumstances described in the previous paragraph, Newlabel may disclose this personal information. This information may include but is not limited to, a member's name, address, phone number, e-mail address, and company name. Affiliated Businesses: Newlabel is affiliated with a variety of businesses and works closely with them for various purposes, including assisting us to perform and improve the Services. These businesses may sell items or services to you through the Services or, with your consent, offer promotions (including e-mail promotions). Newlabel may also provide services or sell products jointly with affiliated businesses, including providing information to such partners to allow them to market effectively to you. When an affiliated business assists in facilitating your transaction, we may need to share information related to the purchase with that related business to facilitate your transaction, and this forms part of the Services we provide following our Terms of Use. We rely on consent (which you can withdraw at any time) to send marketing messages and for third-party sharing relating to advertising.
Aggregated Information: As part of our efforts to maintain and grow the Services, we may share information about the demographics of our members with our business partners. This information will be in an aggregated format and will be depersonalized so that no personally identifiable information is disclosed.
Service Providers: Newlabel also needs to engage third-party companies and individuals (such as payment processors, research companies, and analytics and security providers) to help us operate, provide, and market the Services. These third parties have only limited access to your information, use your information only to perform these tasks on our behalf, and are obligated to Newlabel not to disclose or use your information for other purposes. Our service providers' engagement is often necessary for us to provide the Services to you, mainly where such companies play important roles like processing payments and shipments and helping us keep our Service operating and secure. In some other cases, these service providers aren't strictly necessary to provide the Services but help us make it better, like by helping us research how we could better serve our users. In these latter cases, we have a legitimate interest in working with service providers to make our Services better.
Business Reorganization: In some cases, Newlabel may choose to buy or sell assets. Such transactions may be necessary and in our legitimate interests, particularly our interest in making decisions that enable our business to develop over the long term. In these types of transactions (such as a sale, merger, liquidation, receivership, or transfer of all or substantially all Newlabel assets), member information is typically one of the transferred business assets. If Newlabel intends to transfer information about you, Newlabel will notify you by e-mail or by putting a prominent notice on the Site and the App. You will be allowed to opt-out before information about you becomes subject to a different privacy policy.
Third Parties: When you interact with our platform, certain aspects of your personal information may be collected by third-party plug-ins. For example, when you see a third-party social network plug-in on a Newlabel web page, such as a button to "Like" the page, you are viewing content provided by a third-party external site. The social network site (or other third parties) may obtain cookies from your web browser, subject to the terms of use and privacy policy of the relevant third-party Site (not the privacy policy of Newlabel).
Furthermore, third parties may use some cookies and closely related technologies on our Site for targeted online marketing, among other reasons. Access to such technologies permits our business partners to recognize your desktop or mobile device whenever you engage with our platform. It is important to note that any time you use third-party websites and external services, you do so under the terms and privacy policies of those third parties. Although we select and manage the third-party technologies that are present on our platform, those technologies are governed by the relevant third-party privacy policies. We can speak only for ourselves; this policy does not apply to third parties (such as other members who sell using the Services or API users) that Newlabel does not own or control or individuals that Newlabel does not employ or manage. If you provide your information to such third parties connected with your use of the Services, different practices may apply to the use or disclosure of the information you provide to them. While Newlabel requires these third parties to follow Newlabel privacy and security requirements, Newlabel does not control the privacy or security policies of such third parties. To the full extent applicable in your jurisdiction, Newlabel is not responsible for the privacy or security practices of these sellers, API users, or other websites on the internet, even those linked to or from the Services. We recommend that you thoroughly read and understand the terms of use and privacy policies of any third parties with which you interact. We suggest that you ask any questions you may have before disclosing personal information.
Necessary for the performance of the Contract between Newlabel and its Members
Newlabel provides a voluntary service; you can choose whether or not you want to use the Services. However, if you're going to use the Services, you need to agree to our Terms of Use, which set out the contract between Newlabel and its members. As we operate in countries worldwide (including in the US) and use technical infrastructure in the US to deliver the Services to you, under the contract between us, we need to transfer your personal information to the US and to other jurisdictions as necessary to provide the Services. Mainly, we must be able to move your personal information across international borders to perform our part in the contract between Newlabel and you.
8. Safety and Security on Newlabel:
Keeping your personal information secure is of paramount importance to us. As a company, we follow industry-accepted standards to safeguard the personal information that we receive. This includes protection during the transmission of the information and the full length of time that we store the data. As a Newlabel user, you can take steps to help prevent unauthorized access to your account information, such as choosing a strong password and signing out of your account every time you finish your session on our platform. When certain sensitive information, like credit card numbers, is submitted to us, we encrypt it with secure socket layer technology (also known as SSL). While we follow industry-accepted standards for the protection of personal information provided to us, there is no digital means of transmitting or storing information that is entirely, absolutely safe. Because of the technological limitations on information safety, unfortunately, we cannot offer a 100% guarantee for the Security of your data. However, we do provide numerous security settings and safeguards for our members. We encourage you to view the full details of our security practices in your account preferences. A brief overview of these security features includes full-site SSL, two-factor authentication, and sign-in notifications.
9. Data Retention: How Long Newlabel Will Keep Records of Your Information
If you decide that you do not want us to utilize your information in providing you with the Services, you have the option of closing your account. Otherwise, we will continue storing your data and providing you with our services for as long as it is required, defined in the policy, or for your account's duration. We continue providing you with the Services.
Newlabel will retain and use your information to the extent necessary to comply with our legal obligations. Also, Newlabel sellers may be required to retain and use your information to comply with their legal obligations. You need to be aware that your account's termination will not necessarily allow you to use your username, e-mail address, or shop name on a new Newlabel account. Please also note that we store log files for internal data analysis. Except for a few specific cases (such as where they are necessary for the improvement of our platform or the Security of the Site, or when we have a legal obligation to store them for a more extended timeframe), we will typically only store these log files for a brief time.
10. Rights of Newlabel Users
You may benefit from several rights concerning your information that we process. Some rights apply only in certain limited cases, depending on your location. As a Newlabel user, you can modify, restrict, or remove much of the personal information associated with your account. You may do this either by contacting us directly or through your account preferences. You may also contact us to request information about what personal data of yours we have on file. In some instances where we process your information, you may also have a right to restrict or limit how we use your personal information. In certain circumstances, you also have the right to request the deletion of your personal information and obtain a copy of your personal information in an easily accessible format. If we process your information based on our legitimate interests, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where needed for legal reasons. Where we use your data for direct marketing purposes, you can always object to using the unsubscribed link in such communications or changing your account settings. Please note that some changes to your account settings may take a few days to take effect.
11. Responsibilities of Newlabel Users
You are responsible for protecting user personal information you receive or process and complying with all relevant legal requirements when you use the Services. This includes applicable data protection and privacy laws that govern how you can use a user's information. Such laws may require that you post, and comply with, your privacy policy, which must be accessible to Newlabel users you interact with and compatible with this policy and Newlabel Terms of Use.
As a data controller, to the extent that you process user personal information outside of the Services, you may be required under applicable data protection and privacy laws to honor requests received from such users for data access, portability, correction, deletion, and objections to processing. If you disclose personal information without the buyer's proper consent, you are responsible for that unauthorized disclosure. For example, disclosures you make or unintentional data breaches. For example, you may receive a buyer's e-mail address or other information to enter into a transaction with that buyer. This information may only be used for Newlabel -related communications or Newlabel -facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer's consent, and subject to other applicable Newlabel policies and laws, you may not add any Newlabel member to your e-mail or physical mailing list, use that buyer's identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance.
If Newlabel and you are found to be joint data controllers of personal information, and Newlabel is sued, fined, or otherwise incur expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify Newlabel for the expenses it occurs in connection with your processing of buyer personal information.
12. How to Withdraw Consent Granted to Newlabel
At any time, you can revoke your consent to our utilization and processing of your personal information. To end our use of your information and your Services, you can close and delete your Newlabel account. You can do this by navigating to the "Privacy" tab within your account preferences. Assuming that there are no outstanding bills, unresolved disputes, policy violations, unfulfilled orders, or other pending issues with your account, we will send an e-mail to confirm your account's termination. Once you confirm your request, the process will take up to two weeks, at which time (to the extent allowed), your account will be closed and deleted.
Depending on which of our Services you've used (such as whether you've made purchases or sales on Newlabel.), we may require to retain certain information for legal, regulatory, tax, security, or compliance reasons for a limited period, after which we will delete it. This deletion is permanent, and your account cannot be reinstated.
13. Changes to Our Privacy Policy
It's important to note that we may amend or update this privacy policy. If we feel that any modifications we make are relevant to your use of the Services, we'll inform you about them in one or more ways:
Publishing the changes via the Services,
Sending an e-mail or message to communicate the changes, or
Announcing a new update to the Apps' platform in the version notes.
It will be up to you to decide whether you wish to continue using our Services according to the new Terms. It is your responsibility to review any changes.
